Terms of Service

1.Our Services

MockItReal is an automated mockup rendering platform. Users can upload designs, select from our template library or bring their own PSD files, and generate high-quality product mockups at scale - individually or in bulk batches. The Services include a web-based interface, dashboard analytics, and for eligible plans, REST API access.

The Services are offered through free and paid subscription plans, processed via Polar (polar.sh). All plans include PSD-native rendering, smart object detection, and multi-format export (JPG, PNG, WebP).

We reserve the right to change, suspend, or discontinue any part of the Services at any time.

2.Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.User Representations

By using the Services, you represent and warrant that:

4. 4.You will not use the Services for any illegal or unauthorized purpose.
5. 5.You will not access the Services through automated means (e.g., bots or scripts) except via our official API with a valid subscription.
6. 6.Your use of the Services will not violate any applicable law or regulation.

We may suspend or terminate your account if we believe any of your representations are untrue or incomplete.

4.User Registration

To use our Services, you must register an account. You agree to:

• Keep your login credentials confidential.
• Accept responsibility for all activity that occurs under your account.
• Not use another person's account without their permission.
• Not choose usernames that are offensive, misleading, or infringe on third-party rights.

We reserve the right to remove or reclaim usernames at our discretion.

5.Subscriptions and Payments

The Services are offered through a free plan and paid subscription plans, billed monthly or annually. Optional top-up packs (additional AI assists or renders) may also be purchased for the current billing period. Current plans, prices, features, and quotas are listed at mockitreal.com/pricing.

• All prices are in US Dollars (USD).
• Payments are processed securely via Polar (polar.sh), our payment provider and merchant of record, using a credit or debit card. Paid subscriptions are charged at the start of each billing period and renew automatically until you cancel.
• You may cancel your subscription at any time through your account dashboard.
• We reserve the right to update pricing with reasonable notice; existing subscribers will be notified before any price change takes effect.
• We may correct pricing errors, even after payment has been received.

6.Cancellations and Refunds

You may cancel your subscription at any time via your account settings. After cancellation, your access continues until the end of the current paid billing period, and you will not be charged again. You can also keep using the free plan without a paid subscription.

Refund Policy - Subscriptions: We offer a 14-day refund window on your first-ever subscription payment. To request it, contact us at app@mockitreal.com within 14 days of that first payment. Refunds apply only to your first subscription payment; renewals, subsequent billing cycles, and any later or returning subscription payments are non-refundable.

Refund Policy - Top-up packs: A top-up pack may be refunded in full only if it has not been used at all. Once you have started consuming a top-up's quota (AI assists or renders), that top-up is non-refundable.

7.Intellectual Property

All content provided by MockItReal - including software, rendering engine, tools, logos, graphics, templates, and designs - is owned by us or our licensors and is protected by applicable intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to use our Services for your personal or internal business purposes only, subject to these Terms.

You may not reproduce, redistribute, reverse engineer, or otherwise exploit our content, code, or proprietary technology without prior written permission.

8.User Contributions and Submissions

You may upload designs, images, PSD files, text, and reviews ("Contributions") to the platform. By uploading, you:

• Warrant that you own or have the necessary rights to your Contributions.
• Grant us a limited license to use, display, host, and process your Contributions solely to provide and operate the Services.
• Acknowledge that certain Contributions (e.g., public reviews) may be visible to other users.
• Agree that we may remove or modify Contributions at our discretion if they violate these Terms.

You retain ownership of your Contributions. We may also use Contributions in anonymized or aggregated forms for analytics and service improvement.

AI Training: We do not use your User Content (uploaded PSDs, designs, or render outputs) to train any artificial intelligence or machine learning model. AI-powered features within the Services process your content only to generate the requested output for you, and the content is not retained for model training purposes.

9.Contribution License

By submitting Contributions, you grant MockItReal an unrestricted, worldwide, royalty-free license to use, reproduce, display, reformat, and distribute them for the purposes of operating, maintaining, and promoting the Services.

You waive any moral rights in your Contributions to the extent permitted by law, and confirm that you have secured any necessary third-party rights or permissions where applicable.

10.Reviews

You may post reviews and ratings on the platform. By doing so, you agree to:

• Post only honest, first-hand experiences.
• Not use profanity, hate speech, or offensive language.
• Not post false or misleading claims.
• Not promote or disparage competitors.

We reserve the right to remove any review at our sole discretion without prior notice.

11.Prohibited Activities

When using the Services, you may NOT:

• Copy, scrape, or extract data from the platform by any means other than the official API.
• Upload unlawful, harmful, infringing, or malicious content.
• Violate the intellectual property rights of any third party.
• Use automated tools (bots, scrapers, crawlers) to access the Services outside of the official API.
• Circumvent, disable, or interfere with security features of the platform.
• Use content from the Services to train or feed AI/ML models without our express written permission.
• Attempt to impersonate another user or misrepresent your identity.
• Harass, threaten, or abuse staff or other users.
• Use the platform for any unlawful, fraudulent, or exploitative purpose.

Violations may result in immediate suspension or permanent termination of your account.

12.Management and Monitoring

We may, but are not obligated to:

• Monitor user activity for compliance with these Terms.
• Remove content we deem harmful, inappropriate, or in violation of these Terms.
• Restrict or block access to certain accounts.
• Report suspected illegal activity to relevant authorities.

13.Copyright Infringement

If you believe your intellectual property has been infringed on our platform, please contact us at app@mockitreal.com with a detailed notice including:

• Your contact information.
• A description of the copyrighted material you claim has been infringed.
• The location (URL or description) of the alleged infringing content on our platform.
• A statement that you have a good faith belief the use is unauthorized.
• A statement, under penalty of perjury, that the information you provide is accurate and that you are the rights holder or authorized to act on behalf of the rights holder.

We may remove the content in question and notify the user who uploaded it.

14.Modifications and Interruptions

We reserve the right to:

• Modify, update, or discontinue any part of the Services at any time.
• Update pricing, features, or plan structures with reasonable notice.
• Temporarily interrupt or suspend access for maintenance, updates, or technical reasons.

We are not liable for any downtime, data loss, or disruption resulting from changes to the Services.

For material changes to these Terms that, in our reasonable judgment, adversely affect your rights, we will provide at least 30 days' advance notice via email or platform notification before the change takes effect. Continued use of the Services after the change takes effect constitutes acceptance of the revised Terms.

15.Indemnification

You agree to indemnify and hold harmless MockItReal and its team members, officers, and affiliates against any claims, damages, losses, liabilities, or legal fees arising from:

• Your use of the Services.
• Your Contributions or uploaded content.
• Your violation of these Terms.
• Your infringement of any third-party rights.

16.Limitation of Liability

To the fullest extent permitted by applicable law, MockItReal shall not be liable for:

• Loss of profits, revenue, data, or business opportunities.
• Service interruptions or downtime.
• Unauthorized access to your account resulting from your failure to secure credentials.
• Third-party conduct, content, or services accessed through the platform.

Our total aggregate liability for any claim arising from or related to the Services shall not exceed the total amount you have paid to us in the six (6) months immediately preceding the event giving rise to the claim.

AI-Generated Outputs: AI-powered features within the Services (including but not limited to background generation, background removal, and auto-enhance) produce outputs based on machine learning models. Outputs may vary in quality, accuracy, or suitability for your particular use case, and MockItReal makes no warranty as to the fitness, accuracy, or non-infringement of AI-generated outputs.

17.Dispute Resolution

Informal Resolution: Before initiating any formal legal proceedings, we encourage you to contact us at app@mockitreal.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve the matter within 30 days.

Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of Moldova.

Jurisdiction: Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Chișinău, Moldova.

Mandatory Consumer Protection: Nothing in this section deprives consumers of any mandatory consumer protection rights afforded by the laws of their country of residence.

18.Electronic Communications

By using the Services, you consent to receive notices, disclosures, and other communications from us electronically, including via email and platform notifications. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

You also consent to entering into agreements and completing transactions electronically (e.g., subscription confirmations, plan upgrades, and checkout processes).

19.Corrections

We may update or correct errors on the platform at any time without prior notice. This includes inaccurate pricing, product descriptions, availability information, or typographical errors.

20.Miscellaneous

• These Terms represent the entire agreement between you and MockItReal regarding the use of the Services.
• We may assign or transfer our rights and obligations under these Terms at any time without notice.
• If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• These Terms shall not be construed against us solely on the basis that we drafted them.
• The Sections titled "Intellectual Property," "User Contributions and Submissions," "Indemnification," "Limitation of Liability," "Dispute Resolution," and "Miscellaneous" shall survive any termination or expiration of these Terms.
